INTELLECTUAL PROPERTY OWNERSHIP
Ideas Plus Logic is the sole creator, developer, and owner of:
- “THE LAST BIRTHDAY” campaign concept and name
- All campaign messaging, slogans, and taglines including but not limited to:
- “No one should celebrate their last birthday alone”
- “Every birthday matters at every age”
- “Last birthdays are happening right now”
- Campaign methodology and implementation strategy
- Visual identity concepts and design specifications
- Social media strategy and hashtag concepts (#LastBirthdayToday, #LastBirthdayChallenge)
- Event transformation protocols and procedures
- Media outreach templates and messaging frameworks
- Political engagement strategies and tactics
- All derivative concepts, expansions, and adaptations
USAGE RIGHTS AND PERMISSIONS
AUTHORIZED USE – AREA AGENCIES ON AGING
Permission Granted: Ideas Plus Logic hereby grants permission to all Area Agencies on Aging nationwide to implement “THE LAST BIRTHDAY” campaign under the following conditions:
Required Attribution:
Campaign Materials:
- All printed materials, websites, and promotional content for internal promotion and network extension must include: “‘The Last Birthday’ campaign concept created by Ideas Plus Logic“. This does not include public posts and promotional posts except for big picture involvement. E.g. ECIAAA recruited Ideas Plus Logic to come up with a concept that is engaging and brings people together and hence they developed “The Last Birthday” Campaign for us and we want to….”
- Event signage must include discrete credit line to Ideas Plus Logic
- Press releases must include attribution: “Campaign developed by Ideas Plus Logic”
Social Media Attribution Requirements: Social media posts must tag or mention Ideas Plus Logic specifically when:
- Announcing campaign adoption or launch (“We are excited to implement…”)
- Explaining campaign origins or development (“This innovative concept was…”)
- Promoting the campaign methodology itself (“The Last Birthday approach…”)
- Sharing campaign results or success stories (“Thanks to this concept…”)
Required Attribution Language for Social Media: Posts describing campaign development must include language substantially similar to: “ECIAAA engaged Ideas Plus Logic to develop an innovative engagement concept. They created ‘The Last Birthday’ campaign for us, which transforms traditional advocacy through…”
Exempted Social Media Posts: Attribution is NOT required for:
- Individual event announcements without methodology explanation
- Routine posts about event logistics (times, locations, directions)
- Participant photos or videos during events
- General aging advocacy content not specifically promoting campaign concept
Permitted Activities:
- Implementation of campaign at local/regional level
- Adaptation of materials for local community needs
- Sharing of campaign methodology with other Area Agencies on Aging
- Media promotion and publicity for local events
- Training staff and volunteers on campaign implementation
Required Notifications:
- Agencies implementing campaign must notify Ideas Plus Logic of participation
- Provide basic metrics and outcomes for campaign effectiveness tracking
- Share media coverage and success stories for overall campaign documentation
RESTRICTED USE – COMMERCIAL ENTITIES
Express Written Permission Required: Any for-profit entity, marketing agency, advertising company, or commercial organization wishing to use, adapt, or reference “THE LAST BIRTHDAY” campaign must obtain express written permission from Ideas Plus Logic prior to any use.
Prohibited Without Permission:
- Use of campaign concept for commercial clients
- Adaptation of methodology for non-aging related causes
- Rebranding or modification of core campaign elements
- Training or consulting based on campaign methodology
- Creation of derivative works or spin-off campaigns
COPYRIGHT PROTECTION
PROTECTED ELEMENTS
The following elements are protected under U.S. Copyright Law (Title 17, U.S. Code):
- Creative Expression: All written materials, campaign narratives, and messaging
- Methodological Framework: Specific implementation strategies and tactical approaches
- Visual Concepts: Design specifications, color palettes, and visual identity guidelines
- Strategic Framework: Political engagement tactics, media outreach strategies
- Educational Materials: Training guides, implementation checklists, staff briefing materials
TRADEMARK CONSIDERATIONS
“THE LAST BIRTHDAY” campaign name and associated slogans may be subject to trademark protection. Ideas Plus Logic reserves the right to pursue trademark registration for:
- Campaign name and tagline variations
- Distinctive visual elements and logos
- Hashtag phrases and social media identifiers
ENFORCEMENT AND VIOLATIONS
COPYRIGHT INFRINGEMENT
Unauthorized use of protected elements constitutes copyright infringement under federal law and may result in:
- Monetary Damages: Actual damages plus infringer’s profits
- Statutory Damages: Up to $150,000 per work infringed
- Injunctive Relief: Court orders to cease unauthorized use
- Attorney’s Fees: In cases of willful infringement

FAIR USE AND EDUCATIONAL EXCEPTIONS
PERMITTED WITHOUT PERMISSION
The following uses are permitted under fair use doctrine:
- Academic research and educational analysis
- News reporting on campaign effectiveness
- Brief quotations for commentary or criticism
- Scholarly articles analyzing campaign methodology
NOT FAIR USE
The following do NOT qualify as fair use:
- Complete reproduction of campaign materials
- Commercial use for competitive advantage
- Substantial copying of implementation methodology
- Use as basis for competing campaign development

INDEMNIFICATION
Organizations implementing the campaign agree to indemnify Ideas Plus Logic against any claims arising from their specific implementation, adaptation, or local execution of campaign elements.
INTERNATIONAL CONSIDERATIONS
This copyright notice applies globally under:
- Berne Convention for the Protection of Literary and Artistic Works
- Universal Copyright Convention
- International copyright treaties and agreements
Organizations outside the United States wishing to implement the campaign should contact Ideas Plus Logic for specific permissions and attribution requirements.
MODIFICATION AND UPDATES
Ideas Plus Logic reserves the right to:
- Update usage terms and conditions
- Modify attribution requirements
- Expand or restrict permitted uses
- Issue additional guidelines for implementation

ACKNOWLEDGMENT AND AGREEMENT
By implementing, adapting, or using any elements of “THE LAST BIRTHDAY” campaign, organizations acknowledge:
- Recognition of Copyright: Understanding that all campaign elements are protected intellectual property of Ideas Plus Logic
- Agreement to Terms: Compliance with all attribution requirements and usage restrictions outlined above
- Responsibility for Compliance: Ensuring all staff, volunteers, and partners understand and follow these guidelines
- Reporting Obligations: Providing required notifications and metrics as specified
- Respect for Restrictions: Understanding that commercial use requires separate permission and licensing
EFFECTIVE DATE AND ENFORCEABILITY
This copyright notice and usage agreement is effective immediately upon creation date (May 27, 2025) and shall remain in effect until modified or superseded by Ideas Plus Logic.
If any provision of this agreement is found unenforceable, the remainder shall remain in full force and effect.
